Powers of Attorney are important if you want someone to act on behalf of yourself or someone other than your self. They must be distinguished from Guardianships which are for someone not able to act for themselves or for someone else because of limited capacity. Powers of Attorney are only effective so long as you are able to act. There are what are known as Durable Powers of Attorney which are effective until you know that someone is not able to act. PA has a specific Medical Power of Attorney. We have our own medical power of attorney which governs many more situations (some people think that a medical power of attorney is only to make life and death decisions this is not so).

Our power of attorney also provides for situations when you may need treatment when you have problems, but they are not life and death situations. Also by law, there are specific situations when requiring specific powers in addition to a general power, such as to make gifts, file tax returns, to file bankruptcy and other specific matters. If you obtain one from a stationary store, or online, it may not be specific to your needs, and you can't correct it when you need it. Powers of Attorney cease when someone is no longer able to act for themselves, such as when they become mentally disabled, die, or other events occur.
